1. Our commitment to your privacy

Our guests' privacy is very important to us. This policy explains what personal information Château des Charmes Wines Ltd. ("Château des Charmes", "we", "us") collects when you visit chateaudescharmes.com, book a tour or experience, shop with us, join Belong, subscribe to our emails or contact us. It also explains, in plain language, the cookies, pixels and other tracking technologies that run on our website, who provides them, and how you can control them.

We are guided by the ten fair information principles of Canada's Personal Information Protection and Electronic Documents Act (PIPEDA). In practice, this means:

• We identify why we are collecting personal information before or at the time we collect it.

• We collect and use personal information only for those purposes, or for compatible purposes, unless you consent or the law requires otherwise.

• We collect it by lawful and fair means and, where appropriate, with your knowledge or consent.

• We keep it only as long as necessary to fulfil those purposes.

• We keep it as accurate, complete and up to date as those purposes require.

• We protect it with reasonable security safeguards against loss, theft, unauthorised access, disclosure, copying, use or modification.

• We make our privacy practices readily available to you, and we are accountable for them.

 

2. Personal information you give us

You may choose to provide personal information when you:

• Submit a contact, event or wedding inquiry form (name, company, email address, phone number and event details).

• Book a tour, tasting or experience. Bookings are handled through Tock and include your name, email address, phone number, party size and payment details.

• Purchase wine or merchandise in our online shop (name, billing and shipping address, email address, phone number and order history). Payment card details are processed by our payment providers and are never stored by us.

• Join Belong, our membership program. Membership details are managed through JoinIt.

• Create an account in our website members area.

• Subscribe to our newsletter or become an insider (email address, processed through Mailchimp).

• Enter a contest, survey or promotion.

• Apply for a position with us.

• Email, call or write to us.

We collect this information only when you voluntarily provide it, and we use it only for the purposes identified at the time of collection and described in section 4. Please do not send payment card numbers or other sensitive financial information by regular email.

 

3. Information collected automatically

When you visit our website, we and the service providers listed in section 5 automatically collect certain information from your browser or device. This includes your IP address, approximate location (city or region), device type, operating system, browser, screen size, language, the pages you view, the links and buttons you click, how far you scroll, how long you stay, the website or advertisement that referred you, and identifiers stored in cookies.

Some of this information can identify you when it is combined with other information held by a provider. For example, Meta can associate pixel data with a logged-in Facebook or Instagram account.

 

4. How we use personal information

We use personal information to:

• Respond to your inquiries and provide the bookings, purchases, memberships and services you request.

• Process payments, ship orders and meet Ontario liquor and age-verification requirements.

• Send you newsletters, event invitations and offers where you have consented (see section 8).

• Understand how our website is used and improve it.

• Measure the effectiveness of our advertising and show you advertising for Château des Charmes on other websites and social platforms.

• Protect our website and business against fraud, abuse and security threats.

• Meet our legal obligations.

 

5. Cookies, pixels and tracking technologies

Our website uses cookies (small text files stored on your device), pixels (tiny images or scripts that report when a page loads or an action happens) and similar tags and scripts. Most of them are loaded and managed through Google Tag Manager. The list below names each technology, who provides it, what it does and the information it collects. Advertising providers may also use the information for their own purposes, as described in their privacy policies.

Google Tag Manager Provider: Google LLC. Category: essential (tag management). What it does: loads and controls the other tags on this list. It collects only the technical information needed to load them. Cookies: none of its own. Provider policy: https://policies.google.com/privacy

Google Analytics 4 Provider: Google LLC. Category: analytics. What it does: reports how visitors find and use our website, including pages viewed, tour booking clicks, contact and inquiry submissions, newsletter sign-ups, device and browser, and approximate location. It uses a pseudonymous identifier. Google Analytics 4 does not log or store IP addresses. Cookies: _ga and _ga_0NE8K529PG (about 2 years). Google Ads conversion tracking and remarketing Provider: Google LLC. Category: advertising. What it does: measures whether visits, inquiries and bookings came from our Google ads, and lets us show Château des Charmes ads to previous visitors on Google and partner sites. Cookies: _gcl_au (3 months) and Google advertising cookies set on doubleclick.net. Controls: https://adssettings.google.com

Meta Pixel (formerly Facebook Pixel) and Meta Conversions API Provider: Meta Platforms, Inc. Category: advertising. What it does: measures the results of our Facebook and Instagram advertising and lets us build audiences of people who have visited our website, and similar audiences, for advertising on Meta platforms. It reports page views and actions such as tour booking clicks, contact and inquiry submissions and newsletter sign-ups, together with browser information. Through the Conversions API, hashed (scrambled) contact details you submit in a form, such as an email address, may be sent to Meta so it can match the action to an account. Cookies: _fbp (3 months) and _fbc (when you arrive from a Meta ad). Microsoft Clarity Provider: Microsoft Corporation. Category: analytics (session replay and heatmaps). What it does: records how visitors interact with our pages, including mouse movements, clicks, taps, scrolling and page navigation, and produces heatmaps and session recordings that we use to improve the website. Text you type into form fields is masked. Clarity also sets a Microsoft advertising identifier through bing.com. Cookies: _clck (1 year), _clsk (1 day) and MUID. StackAdapt pixel Provider: StackAdapt Inc. Category: advertising (programmatic). What it does: measures our display, video and native advertising served on other websites and apps, and lets us show Château des Charmes ads to previous visitors. It collects page views, the referring campaign and a pseudonymous identifier. Cookies: sa-user-id, sa-user-id-v2, sa-user-id-v3 and sa-user-id-v4 (1 year). d36i Attribution Linker Provider: d36i Analytics. Category: analytics (marketing attribution). What it does: records the campaign, channel or referral source that brought you to our website so we can attribute bookings and inquiries to the right marketing channel. It collects the page URL, referrer, campaign parameters and a pseudonymous identifier. Cookies: stores an identifier in your browser. Details: contact us (section 15).

Wix platform Provider: Wix.com Ltd. Category: essential. What it does: hosts our website, online shop, forms and members area. It sets cookies required for security, session management, load balancing, fraud prevention, and to remember your cart and log-in. Wix also uses Sentry error monitoring so the site works reliably. Cookies: XSRF-TOKEN, hs, svSession, bSession, ssr-caching and server-session-bind (session to about 2 years). 5.2 Embedded services from other providers

Some pages include tools from other companies. When you use them, those companies collect information under their own privacy policies:

Links to Facebook, Instagram and TripAdvisor on our website are ordinary links. Those companies collect information only once you leave our website.

 

5.3 What these technologies do not do

These technologies are designed to measure how our website and our advertising perform. They are not used to read your email, your private messages or the contents of your device. We do not sell your personal information for money. Some advertising providers (Meta, Google and StackAdapt) receive information about your visit so that we can measure and target our advertising. In some jurisdictions this may be considered "sharing" or "targeted advertising", and you can opt out as described in section 6. We do not intentionally send payment card details to any analytics or advertising provider.

 

6. Your choices

Cookie preferences. When you first visit our website, a cookie banner lets you accept or decline analytics and advertising cookies. You can change your choice at any time using the Cookie Settings link in the footer of every page. Essential cookies cannot be turned off because the website, shop and booking tools do not work without them.

Browser settings. Most browsers let you block or delete cookies. If you block essential cookies, parts of our website, including checkout and bookings, may not work.

Provider controls. You can also opt out directly with each provider:

Email. Every marketing email we send includes an unsubscribe link. You can also email us at the address in section 15. Do Not Track. Our website does not currently respond to browser Do Not Track signals. Use the cookie banner and the controls above instead.

7. Who we share personal information with, and where it is stored

We share personal information with service providers who help us run our business, including website hosting, bookings, payments, membership management, email delivery, analytics and advertising, and only to the extent needed for them to provide their services. We may also disclose personal information where required by law, to protect our rights or safety, or as part of a sale, merger or reorganisation of our business.

Our service providers store and process information in Canada, the United States, the European Union and Israel (Wix). While it is outside Canada, personal information is subject to the laws of those countries and may be accessible to their courts, law enforcement and national security authorities.

8. Email marketing and Canada's Anti-Spam Legislation

We send newsletters, event invitations and offers only where you have given express consent, or where an existing business relationship permits it under Canada's Anti-Spam Legislation (CASL). Every message identifies Château des Charmes as the sender and includes a working unsubscribe link. We process unsubscribe requests within 10 business days.

9. Legal drinking age

Our website offers wine for sale and is intended for people of legal drinking age in their province or territory (19 in Ontario). We do not knowingly collect personal information from anyone under the legal drinking age. If you believe we have collected such information, please contact us and we will delete it.

10. How long we keep personal information

We keep personal information only as long as necessary to fulfil the purposes for which it was collected, to meet legal, accounting and tax requirements, and to resolve disputes. Analytics and advertising cookies expire on the schedules shown in section 5.1. You can withdraw consent or ask us to delete your information at any time (section 12).

11. How we protect personal information

We protect personal information with reasonable physical, organisational and technical safeguards appropriate to its sensitivity. Our online shop and booking tools use industry-standard encryption. Access to personal information is limited to staff and service providers who need it to do their work.

12. Access, correction and withdrawing consent

You may ask us at any time to see the personal information we hold about you, to correct it, or to withdraw your consent to its collection, use or disclosure (subject to legal and contractual restrictions and reasonable notice). Withdrawing consent may mean we can no longer provide certain services, such as membership or email updates.

We will respond to your request within 30 days. There may be a reasonable cost associated with providing a copy of your information, which we will tell you about in advance.

If you have a complaint about our handling of your personal information, please contact our Privacy Officer first (section 15). We will investigate and attempt to resolve every complaint. 13. Additional rights in some jurisdictions

Depending on where you live, you may have additional rights, including the right to have your personal information deleted, to receive a copy of it in a portable format, or to opt out of targeted advertising or the sharing of your personal information. Residents of Quebec, the European Union, the United Kingdom and California, among others, may contact us at the address in section 15 to exercise these rights. We will honour every request that applies to you under the law of your jurisdiction.

14. Changes to this policy

We may update this policy from time to time as our website, our tools or the law change. We will post the new version on this page with a new effective date. Significant changes will be highlighted on the page or communicated by email where appropriate.
